John Yoo is a well-known Korean-born American lawyer and retired government official. John Yoo currently holds the position of Emanuel S. Heller Professor of Law at the University of California, Berkeley School of Law.

He rose to prominence in the early 2000s as a result of his legal opinions on executive power, warrantless wiretapping, and the Geneva Conventions while working in the Department of Justice’s Office of Legal Counsel (OLC) during the George W. Bush administration.

He is also the author of the contentious Torture Memos, which established the legal limits for detainee torture during the War on Terror.

In both 2008 and 2014, some individuals and groups demanded that he be investigated and prosecuted under numerous anti-torture and anti-war crimes statutes.

Yoo has held the Fulbright Distinguished Chair in Law at the University of Trento and has taught at the Free University of Amsterdam, the University of Chicago, and the Chapman University School of Law.

He has also been a visiting scholar at the American Enterprise Institute, a conservative think tank in Washington, DC, since 2003. Yoo also contributes a monthly column called “Closing Arguments” to The Philadelphia Inquirer.

In 2019, he said on Fox News, “Some might call that espionage,” when discussing Lt. Col. Alexander Vindman, the National Security Council’s top Ukraine expert.

The next day, Alexander was scheduled to testify before Congress about Trump’s request to Ukrainian President Petro Poroshenko to launch an investigation into his political rival Joe Biden.

Yoo later apologized, saying, “I truly regret the choice of words,” and that he was referring to Ukrainian officials rather than Alexander.

He praised Trump as a “constitutional conservative” in 2020. Defender in Chief: Donald Trump’s Fight for Presidential Power is Yoo’s 2020 book about Trump.

In an August 2020 interview on CSPAN, he defended the use of enhanced executive privilege within the Trump administration.

Yoo stated in a concurrent CBS interview with Ted Koppel that his support for Trump could be guided by his possible reading of PEADs (Presidential Emergency Action Documents), which would supplement Trump’s support for enhanced executive privilege during wartime and other national emergencies.

Following the failure of Trump’s re-election bid in the 2020 United States presidential election, he proposed a path for the Supreme Court to decide the outcome of the election.
