“If the IG of Police fails to carry out the warrant, said warrant shall remain valid and be carried out whenever, including after Kinoti departs the DCI’s office,” Judge Mrima stated.

The High Court denied a request to postpone the punishment.

In a virtual court session on Monday morning, Justice Anthony Mrima ruled that the earlier rulings, which sentenced the investigators’ boss to four months in prison, should stand.

Kinoti had requested that the incarceration order be reversed through Attorney General Paul Kihara because the Court had imprisoned the wrong person.

Kinoti, according to the attorney general, is not in charge of the firearms.

In contrast, businessman Wanjigi has argued that the DCI chief, not the firearm licensing board, is in command of his firearms.

The judge ordered Kinoti to report to prison before reaching a judgment.

On June 21, 2019, Justice Chacha Mwita handed Kinoti 30 days to return Mr. Wanjigi’s firearms, as requested.
